2023 – Harry Agate Jailed Again for Breaching Sex Offender Restrictions

Harry Agate has been sent back to prison for a second time after breaching the requirements placed on him under sex offender legislation.

Agate, now 28, was made subject to a Sexual Harm Prevention Order (SHPO) following an offence in 2017 and was placed on the Sex Offenders Register.

Under the terms of the order, he is required to notify police within three days of any changes to his circumstances, including his address, use of aliases, bank account details and passport information. He was also prohibited from using a mobile phone or any electronic device capable of accessing the internet unless it had been disclosed to police, and he was ordered to make devices available for inspection upon request.

In the summer of 2020, officers visited his then home in Tilton Court, Peterborough. During that visit, Agate admitted he had a second phone that had not been declared to the authorities. The device had been used to set up WhatsApp and Facebook accounts.

He later pleaded guilty to two counts of breaching his SHPO and was sentenced at Peterborough Crown Court to one year and eight months in prison.

In May 2022, specialist officers responsible for managing violent and sexual offenders visited Agate at his registered address in Peterborough. However, they were informed that he had moved out some time earlier following an argument with a housemate.

Agate, who was subsequently described as having no fixed address, was later arrested and admitted failing to comply with his notification requirements.

He was sentenced to a further one year and four months in prison at Cambridge Crown Court on 6 September.

Following the sentencing, Detective Constable Faye Patterson said specialist officers — known as MOSOVO officers — are trained in the management of violent and sexual offenders and are dedicated to ensuring individuals subject to such orders comply with the restrictions placed upon them.
