Warrington Man Avoids Jail After Assaulting Woman and 12-Year-Old Child

A Warrington man has avoided prison after admitting assaulting a woman and a 12-year-old child during a late-night incident.

Duane Garrathy, of Eden Avenue in Culcheth, appeared before Warrington Magistrates’ Court for sentencing after being convicted of two counts of assault by beating.

The court heard that police were called to the address at around 1.57am on November 1 following reports of a disturbance.

Prosecutors said Garrathy had become drunk and aggressive during an argument before chasing a 12-year-old child up the stairs of the property.

A woman attempted to intervene and stop him by grabbing his legs. During the confrontation, Garrathy spat twice at the woman, hitting her face and hair.

He then continued up the stairs where the child was standing and shouted before striking the child twice to the back of the head.

The court heard the child fell to the floor crying following the assault.

After the incident, Garrathy left the address and drove away.

Magistrates were told the incident occurred after Garrathy had been drinking and had become increasingly aggressive.

At sentencing, the court imposed an 18-month community order rather than a custodial sentence.

As part of the order, Garrathy must complete a six-month alcohol treatment programme, undertake 20 rehabilitation activity days, and carry out 140 hours of unpaid work.

He was also ordered to pay £199 in court costs.
