Man Sentenced for Sexually Touching Stranger Without Consent in Jersey
A man has been sentenced to community service after pleading guilty to sexually touching another man without consent in an incident described by the court as “selfish and unwarranted.”
José Marcio Oliveira Lucas, 46, appeared before Jersey Magistrate’s Court, where he admitted to a charge of sexual touching without consent.
The offence occurred when the victim was walking in public. According to evidence presented in court, Lucas whistled at the man and asked if he wanted to smoke. When the man declined, Lucas approached and grabbed the victim’s genitals over his trousers.
The victim attempted to follow Lucas as he fled the scene but was unable to detain him. A police investigation was launched, and Lucas was later arrested at his home after being identified based solely on a witness description.
During sentencing, the court heard that the assault had a significant emotional impact on the victim. The prosecution described the behaviour as unprovoked and deliberate, while Lucas’ defence submitted character references and noted that he had pleaded guilty at the earliest opportunity.
The court was told that Lucas had no prior relevant convictions and that a probation report supported a community-based sentence.
Assistant Magistrate Adam Clarke described the incident as “selfish and unwarranted,” stating that while the offence did not meet the threshold for custody, it had nonetheless caused serious distress.
Lucas was sentenced to:
• 120 hours of community service, to be completed within 12 months
• A six-month probation order, requiring regular supervision
