A depraved Edinburgh man found guilty of a series of sex offences tried to accuse his victims of making false police reports against him, a judge has found.

Kyle Kernachan, 29, was convicted in April, 2025 of carrying out sexual attacks on two women, including one rape and a separate sexual assault involving a crowbar.

The case was brought before the Edinburgh High Court and he was sentenced in May to eight years in prison. However Kernachan appealed shortly after, claiming he discovered “significant evidence not heard at the original trial”.

The appeal hinged on claims Kernachan’s two victims tried to persuade an acquaintance to make fabricated reports and “had each said they would go to the police to make false allegations against him”.
A judge today (December 18) struck down the claims, deeming Kernachan’s story to be “a concoction”

Court documents stated: “the evidence founded on is not capable of being regarded by a reasonable jury as credible and reliable” and there “has been no miscarriage of justice”.
It added one of Kernachan’s witnesses gave “glib” and “unconvincing” evidence, even fleeing from the court in distress twice when her account “began to unravel”.

The judge added: “[The witness] gave every impression of having practised an account that of itself made little sense”.

Kernachan carried out the attacks on two separate occasions in the capital. Between February 3, 2015 and October 31, 2016 he assaulted a victim with a crowbar or similar implement to her injury at a property on Marine Drive, Silverknowes Beach, causing her to “bleed internally despite her refusal”.

In a separate attack, Kernachan assaulted a second victim in a property on Granton View in Edinburgh. During the attack he removed the woman’s lower clothing and exposed her breasts.

He then went on to rape her while she was intoxicated, asleep, and incapable of giving or withholding consent.
